I can easily see this happening, most of who they'd end up banning likely have committed a crime in some way but now they've got the few innocents mixed in. What about that person who might have accidentally received their copy off of amazon or elsewhere a few days early by mistake? What about a small game shop somewhere that also did the same of maybe selling it a bit early or something without knowing it?
If the console had a clock and calendar on it that was always correct and could not be altered by a human being, you'd think they could make games check the release date and just not play if they haven't been released yet. They aren't taking the best approach to it as is. People go online to play this, you'd think they could pull the date and if it's too early, just block the game. Ninten-derrrrr, if they aren't sending a cease and desist letter somebody's way over stupid crap, they are probably doing something even dumber.
